Legal challenges to smoking ban

A football social club is one of three parties which are seeking a judicial review to halt Scotland's ban on smoking in enclosed public places.
어떤 미식축구 사교적 클럽은, 공공연한 공중장소에서 흡연하는 것에 대한 스코틀랜드의 금연(금지)를 멈추도록하는 재판의 재검토를 찾고있는 세 모임중에 하나이다. 

Edinburgh City Council Football Club wants the ban, which comes into force on 26 March, to be declared unlawful.
에든버러(스코틀랜드의 수도) 도시의 협회 미식축구 클럽은, 3월 26일에 무력으로 이르른 금지령(금연)이 비합법적인 것으로 선언되기를 원한다.

It has take n its case to the Court of Session along with a pub and hotel chain and an individual smoker.
그것(금지령)은 이러한 경우에 술집, 호텔같은곳, 개별적 흡연자와 함께 하는 만남(회합)의 장소에서 필요로 해왔다.

At a brief court hearing, Lord Brodie said a date had yet to be fixed for a review of the smoking regulations. <!-- E SF -->
간결한 공청회(들을수있는장소)에서, Lord Brodie는 오늘날 아직까지 흡연 규정의 재검토가  고정(정착)되어있다고 말했다.

The judicial reviews are seeking to have the smoke ban regulations declared as outwith the devolved competence of the Scottish Parliament.
재판에 의한 재검토는 스코틀랜드 의회의 양도된 권한도 없이 이미 선언되어버린 금연 규정을 있는 지를 찾고있다.

The 270-member social club and one of its members, Brian Meachan, are concerned that income will fall if members and their guests are not allowed to smoke on the premises.
270명의 멤버로 구성된 사교적 클럽과 그 멤버들 중 한명인 Brian Meachan은, 멤버들 그리고 그들의 손님들에게 담배 피우는 것이 허락되지 않는다고 전제한다면 수입이 떨어질 것이라고 걱정했다.

Mr Meachan, 63, was said to be more likely to stay at home to drink and smoke than travel to the Baxter Place club because of the regulations.
63세의 Meachan씨는, 규정(금지) 때문에 Baxter Place 모임에 (담배를) 외판(판매)하는 것보다는 집에서 머무르며 담배를 피우고 연기를 마시는 확률이 높다고 들었다.

He said the practical effect of the smoking ban would be that he would not go to the club as often, but would stay at home so that he could have a smoke and drink at the same time.
그는 실질적인 금연의 결과는, 종종 모임에 나가는 것이 아니고, 연기를 마시고 동시에 담배를 피우는 것을 하기 위해 집에 있게 될 것이라고 말했다.

Edinburgh City said that because of the location of the club there were no practicable areas belonging to it where smoking could take place in the open air.
에든버러 도시는 모임의 행사 때문에 흡연을 할 수 있는 개방된 곳에 속하는 실질적인 지역들이 없다고 말했다.

Guests and members would require to go outside and stand on the pavement if they wished to smoke.
손님들과 멤버들은 그들이 담배를 피우기를 원한다면 포장도로에 있기를, 그리고 외부로 가기를 요구할 것이다. 

London and Edinburgh Inns, which operates about 50 pubs in Scotland along with the Swallow Hotel group which runs 61 hotels, is also challeng ing the ban.
런던(영국의 수도)과 61 호텔을 운영하는 Swallow호텔그룹과 함께 스코틀랜드에서 약 50여 술집이 일하는 에든버러 여관들은 또한 금지(흡엽금지)를 하고 있는 중이다.

A smoker has raise d a similar action, claiming he will be discriminated against under the plan.
흡연자는 그 방식 하에 반대하여 분간(구별, 차별)되기를 요구하면서 유사한 행동을 나타낼것이다.
 

Donald Lawson, of Feithlinn, Dalfaber Road, Aviemore, in Inverness-shire, said in his action that he has been smoking since he was a teenager and was addicted to nicotine.

He said the smoking regulations were "a disproportionate interference with the right to respect for his private life" as guarante ed by the European Convention on Human Rights.

Mr Lawson claims that a blanket ban on him smoking in such premises "is not necessary in a democratic society" and that pubs and bars could designate smoking rooms.
Lawson씨는 "민주사회에서 필요하지 않다"는 것을 전제로 흡연에 총괄적 금지를 주장하고, 술집과 바(bar)들은 흡연장소를 나타낼 수 있다는 것을 주장한다.

Lord Brodie agreed to make an order for service of the petitions on Scottish ministers and Scotland's senior law officer, the Lord Advocate Colin Boyd QC.
Lord Brodie씨는 스코틀랜드의 장관과 Lord를 대변하는 Colin Boyd QC라는 스코틀랜드의 지긋한 법공무원에게 청원(탄원)의 봉사에 관한 순서(질서)를 만들 것을 의견이 일치(동의)했다.
